2006:07 GENDER AS AN IDENTIFIABLE GROUP IN THE CRIMINAL CODE
Whereas: the Criminal Code of Canada states that “Public Incitement of Hatred” and “Wilfully Promoting Hatred” against an identifiable group is an indictable offence; and
Whereas: the term “identifiable group” includes colour, race, religion, ethnic origin or sexual orientation, but does not include gender; and
Whereas: police departments report a significant number of hate crimes based on gender; therefore be it
Resolved: that the National Council of Women of Canada adopt as policy that hate crimes based on gender be an indictable offence; and be it further
Resolved: that the National Council of Women of Canada urge the Government of Canada to include gender as an “identifiable group” in hate crime as set out in the Criminal Code of Canada.
